Trust Me - I'm a Probation Officer!

I've always felt that a bit of self-analysis is no bad thing. Indeed I would say it's an absolutely vital trait for any aspiring probation officer and it's certainly something we would wish to encourage many of our clients to embrace. Trying to understand why we do things is almost certainly a healthy pre-requisite for trying to understand why other people do things. Uncomfortable though it may sometimes be, in order to aid this process it can often be helpful to hear what others feel about us. In this context I have recently drawn readers attention to the Prisoners Families Views website which often contains worrying and uncomplimentary examples of probation involvement.

On the Prisoner Ben website there has been some wide-ranging and healthy discussion about various issues, including the role, responsibilities and effectiveness of probation. I have taken the liberty of quoting some comments and views from a recent post entitled 'World's Apart' in order to give a flavour of the discourse.        


"These guys give every indication of believing that they help us, supports us, try to get us out.

Prisoners believe that they are inept, dishonest and look for any excuse to keep us in."

"The word Probation officer is red rag to a bull to me. I have only ever met one decent one ........... I dare say there may be one or two well meaning ones, but on the whole, most of them have got my back up. It is like dealing with nethanderals, they are so terminally stupid, they can't even write acurate notes in your file. Which is a worry if your liberty depends on it. They are not to be trusted, anyone with any sense should just tell them what they want to hear. God help the poor people who could really use a helping hand when they get out. By the way, if anyone reading this thinks the problem is me, i would understand why you would think that, but no-one else on this earth has made my blood boil like my old probation officer. Prison staff, some good ones, some bad. like everywhere, (except probation, all with micky mouse degrees from some third rate college."


"Its the new generation probation officers, or, in my case social workers who I am more worried about. What they get taught in college these days especially psychology is closer to victim blaming than anything. They then come to the 'profession', maybe with huge financial debts due to the high cost of education or supported by their parents, but know little and want to do as they are told which is to put the blame squarely back onto those who they are supposed to be helping.

These days the gap between social workers (as I have more experience of them than prison staff or probation) is even bigger and from what I can gather, nobody is happy, not the 'clients' nor the staff. Only those reaping in the dollars from costs cuts and privatisation, they are the ones sporting big cheshire cat got the cream smiles, while we suffer."

Many would agree that much of this, whilst making for uncomfortable reading, is not particularly  surprising given the position we occupy in the criminal justice system. After all a prisoner is unlikely to agree or be happy with an officer making a negative recommendation for early release on Parole Licence. Or if recommending release, for suggesting conditions that might include hostel residence, exclusion zones, programme attendance or curfews. But even back in 'the good old days', public protection has always been part of the job when we were all social workers and 'helping' people. Being a probation officer never has been about winning a popularity contest with clients, but even I can see that things may have gone a bit too far.

From all the quotes above it's this one that seems to sum the issue up:-

"They are not to be trusted, anyone with any sense should just tell them what they want to hear."

Obviously there is only one way in which trust can be achieved and that is by earning it. I well remember many years ago and being the 'new boy' in the team, listening to my senior in supervision telling me that the best thing to do was not to listen to my colleagues, but go to him instead as he 'could be trusted.' I remember thinking 'not bloody likely mate - I decide if you can be trusted or not.' Similarly I wouldn't necessarily expect a client to trust me from day one, but rather it would be my aim to build trust and mutual respect as time went on, both when we agreed on things and hopefully when there were differences of opinion. 

A very long-term lifer of mine illustrates the issues raised in this quote perfectly. He has spent many years denying the index offence, whilst blaming his co-accused. I always made it plain that I didn't believe him and regularly reminded him that neither did the Jury or Appeal Court. He would regularly say to me 'just tell me what you want to hear.'  To which I would reply 'just tell me the truth.' He would say 'how will you know it's the truth?' and I would reply 'just try me.' This impasse has not assisted with his sentence progression.

I've seen this sentiment expressed quite a few times on various internet sites 'just tell the probation officer what they want to hear', seemingly in the naive belief that we can't tell fact from fiction or bullshit from sincerity. Trading insults is never attractive or useful but I can honestly say probation officers are not stupid. Indeed it could be argued that if there is any stupidity at all it is often evident on the other side of the desk because the one thing all our customers have in common is that they got caught.

All probation officers only want to hear the truth or honestly held opinions. Getting to the truth means reading the evidence, observing behaviour, listening carefully, investigating sources, questioning, challenging, assessing. It really is nonsense to think that our views or opinions can be swayed by simply 'telling us what we want to hear.'  It's nonsense for all sorts of reasons, not least because it should surprise no one that many people facing criminal proceedings quite often lie a lot. It's often an automatic default position - just watch a few real-life police programmes on tv if you don't believe me.

One of the real skills of a probation officer is to try and build trust with a client and get them to consider options other than this automatic default position. It often takes time, but in the end enables the officer to try and help them sort out their life. It means that court reports or parole reports can be written with real conviction on the part of the officer trying to make positive recommendations. It means that the officer's integrity has to be of the highest order and sometimes that officer will be faced with professional dilemma's that are not easily resolved.

Trust is a two-way street and has to be earned, but I believe remains the cornerstone of our work if we are to be helpful and effective.

  1. This makes me laugh. I had a video conference with a probation officer and afterwards I found he had completely fabricated what was said and discussed. After release I got a DPA Subject Access and found my current one was writing wild and inaccurate things in my file - going even to claiming meetings and discussions which never took pace (proven).
    Until POs stop running scared, lying and acting in a totally disreputable way you will continue to be looked on with disdain.
    I had about 50 pages of reports and notes corrected but only after getting the Information Commissioner involved because Probation did not understand their obligations.
    It's time you learned that it's not some kind of playground game you are playing, and more and more released prisoners are aware of their rights and your individual responsibilities.

    1. My wife has had 3 PO's. The first was great and was completely supportive. The second was neutral and didn't want to be bothered by seeing my wife as he felt she was obviously innocent and never should have taken a plea for something she didn't do. The third has been unprofessional, condescending, psychoanalyzed my wife even though she never read the file (PO's admission) and made appoint of telling my wife again and again that she was guilty and needed to accept it in her first interview.

      My wife is disabled and has stress induced seizures made all the worse by being arrested on suspicion and prosecuted for something that she never did and no motive to do. The case was nearly thrown out and the DA didn't even want to touch it, but a police officer who wanted a promotion (and got it) hounded the DA to prosecute and eventually convinced him to do so. The emotional and financial toll as well as the toll socially has been devastating to us. As a consequence her seizure disorder was greatly magnified and what became 1 or 2 seizures a year became 1 or 2 seizures a week!.

      I told all of this to her new PO and begged her to please not make her rehash everything. The PO ignored this and probed her in detail and then condemned my wife as she sat their in tears. My wife came home shattered emotionally and as she sat in her chair had a bad seizure in front of my children. My wife is so intimidated by her PO she had a seizure the day of their next meeting. The PO took it personally that my wife did not make the appointment the day of her seizure and told my wife "you need to call ahead if you can't make it due to illness"! The PO also told us that she cannot accept communication from me due to confidentiality. I am sure this is a lie because there is nothing confidential about me calling in and saying "My wife had a seizure and can't come in, can we reschedule?". I am paid by the county to care and advocate for her which the PO knows! All of the information about this is in her file which the PO has not read. So there are all types of PO's as there are all types of people. Unfortunately, this sort of job draws people who get off on power. There are also those who really want to help. You seem to be an honest, reasonably intelligent and professional person, so I ask you this, how can we get a new PO for my wife? This PO is physically harming my wife by causing unnecessary stress. I also can't work my other job as a Respiratory Therapist when my wife is incapacitated from the after affects of a seizure, which has a financial and stress inducing impact. Who do we go to? Do we need a lawyer or do we need to contact her supervisor?

  2. Thanks for commenting. It's always sad to hear of situations like you describe. In particular I'd make the point that video conferencing is completely unsuitable in my view for trying to establish a relationship and as a means for discussing difficult and serious issues. I'd be really interested to know if you'd met your officer face to face before, or was the first meeting by video conference?

    I hope you might agree that not all officers can be condemned on the basis of your experience, no matter how bad that might have been. Standards and practice vary in all walks of life, but you will appreciate that sometimes an officers viewpoint will necessarily differ from that of a client. That is no excuse for lying or fabricating however and of course rights and responsibilities apply to all, including those convicted of offences.

    1. I have a question for you... I am on probation as of right now, I had my first appointment today and of course I am dog sick. I call down there to ask if I can come in tom and the man answers the phone, doesn't speak wait on me to talk. I tell him what the problem is and tell him I could come in tom at any time he wanted. All the man said was "that's fine" and hung up. Ok so I don't know when they want me to go in tom so I call him back. What a mistake, this man start pretty much asking me if I am dumb saying things like " did you not understand what I said" and " did you not understand what you said". All I wanted to know was a time to be there. This man has no communication skills or people skills. Now mind you I have already served a year in drug court and have passed with flying colors, never been late and this is my first time in trouble! I have also completed the drug and alcohol program flawlessly and paid for both programs out of pocket, while never missing a day or failing a drug test. Who can I speak to or how do I go above this man head so I don't have to deal with him any more? I have never met someone who was so rude and out of line in my life! This man should be fired at the least!!

  3. my son has a probation officer who truly gets off on her power. she lies in front of the judge, says one thing to me and my sons lawyer and then gets the commonwealth attorney to say very different things than we expected.

    She is a closet lesbian (looks just like jodie foster with her hair pulled back) so clearly when she gets in the court room to crucify my son it is for many other reasons than just what my son did

  4. It's always very sad to hear of such experiences as you describe. Fortunately I believe such behaviour that you describe - here in the UK anyway - is extremely rare, but it does happen. I had the misfortune of working with a colleague once who also 'got off on the power' but didn't last long I'm pleased to say.

    1. Can my fiancé's parole officer demand a no contact order between us? There's no PFA out and I never sent him to jail for Dom violence. Also I had nothing to do with his crime. Ty,Jessica

    2. Yes ,in Wisconsin where I'm from my boyfriend's probation officer actually put a no contact order on us I asked her to lift it so he can move back in since he never laid a finger on me ever and she did lift it...

  5. i literally have just come back from p.o. and i think he does't believe me but there again he looks as though he can't be trusted himself.thing is i'm no more clued up than i was when arrested it's my first offence and i'm bricking it as my sentancing is on the 28th march he said he doesn't yet know what to put or what he is going to do thing is i think i do! what do i do now?

    2. My only advice is to try and engage with the officer - tell them as much as you can about yourself and the offence - don't try and obstruct the process or make stuff up - it'll just make matters worse in the long run.

  6. A Probation officer's first remit is not to the client as in the old day of assist and befriend etc but to public protection and that can mean anything and is highly subjective. The old days when a PO would undertake the Diploma in Social Work has now been replaced by the Diploma in Probation Studies which is heavily focussed on risk management and public protection. Today, more than ever, probation officers are recalling offenders to prison like its going out of fashion so that the offender will have to start all over again on release if he or she has lost their job, housing etc. I will always advise offenders that probation officers do not exist to help or encourage, they see risk coming out of the woodwork and will recall at the drop of a hat. They are not to be trusted. Don't try and build a relationship with anyone who has the capacity of sending one to prison and never tell them you have problems for too often problems are seen as risks. Too many offenders believe that a smile from their PO and 'how are you' are sincere gestures. No they are not. They're about as sincere as a fox hunter telling you he loves foxes. Just jump through the hoops and tell them what they want to hear. They are not mind readers although they have a notion that they are and can predict the future. They are closer to law enforcement than social work that I wouldn't be surprised if at some time in the future they will be given powers of arrest and search.

  7. thanks for that jim but to be honest i've had my second encounter with him and all he keeps going on about is that night after saying it'll be a fresh start. well i can tell you he said some offenders have horns and need burning at the local clock tower his words entirely to me this guy is patrinizing and that statement wasn't very professional. no matter what no one is perfect i know but i did tell him it will take some time for me to openly discuss myself and the offence he said he understands.however he tries to trip me up every now and then if i'm honest i would be better off in prison this guy just makes me depressed and feel like crap basically i'm one of these people to keep my calm but i feel as though sooner or later i'll find myself waiting till he finishes work and batter him i'm the one who was sentanced on the 28th march

  8. cheers for the post to annymous on the 17 march i now realise it wasn't the po it was the om which to be quite honest i don't know what the difference is but he the om seems to get off on his power.now my arguement is that can these so called om's can they just get a police officer to accompany him to a meeting with me? and also do i have a right to sit there on my own say yes sir yes sir you know the score without a solicitor because he seems to be bullying me into something can't put my finger on it.and if i can't then do i hold my hands up and say basically yes i did that as well plus will i get rearrested if i did any comment will be greatly apprecieated.

    1. Well, Offender Manager is a term that can cover either a qualified Probation Officer or Probation Services Officer. In some Trusts they are dropping use of OM and going back to either PO or PSO.

      I think you need to get some legal advice regarding your situation.

I'm on cc1 and my Po is just being a straight asshole towards me saying that I can't be in my pool because there are no pools in prison but it's on property And he is trying to get involved in my personal life askin me questions and what not that's non of his business and that I have to be confined to my walls because that's how it is in prison which is not true in prison u can come and go as u please from your cell during a certain time I was thinking about going to his supervisor but I'm trying to apply for early termination of cc1 in 3 weeks

    Probation Officers are paid to ask personal questions. My advice is cooperate with him/her, but if you are not happy for any reason, by all means request to speak to the manager.

  11. I've just been breached by my probation officer because I insist on continuing to protest my innocence. They say that it is impossible for them to work with me and as such my behaviour is non compliant with the court order. Maybe, just maybe, it really is because I'm innocent. Although I suspect that It didn't help me making a complaint about their behaviour towards me. I found them to be extremely patronizing and unwilling to allow me my right to an opinion. They actually accused me of being stupid. I've just read her report to the court and, well, what can I say? It's full of unsubstantiated defamatory and libelous opinions. So my question is, where's the accountability lie? How on earth can I prove their word to be nothing but defamation and the whole breach borne out of revenge for my making a complaint. One which, surprise, surprise was found to have no credence when allegedly investigated by her supervising officer. I might add that they are still yet to supply me with an evidence that any such investigation ever took place.

    1. Well it's always difficult when someone is made subject to any community order and they are maintaining innocence. I don't know if you pleaded guilty or were found guilty following trial, but either way you are convicted and the court order must be complied with, or breach action will properly be taken.

      I would be interested to know if you were appealing or not and I personally would allow some leeway until the appeal process was concluded, but you still have a responsibility to comply and that does require your engagement, not just turning up for appointments. However, I don't know the details - the order may be unworkable for example in a groupwork setting by your denial, in which case a return to Court for re-sentencing would seem appropriate.

      The issue over the PSR is a different matter and as you say, you made a complaint. If you are not satisfied with the outcome of the investigation you can take matters further and ultimately to the Prison and Probation Ombudsman. There is most definitely an accountability process.

    2. Protesting your innocence is NOT a breach of the order.
      As long as you are complying, you can claim to be innocent as much as you want.

      They should accept your view and continue. They are not police, they cant sit there assuming you are guilty all the time.

  12. Ok , here is on for you. What happens when you get finally out. And you have a job and go to all the meeting. Your out you get falsely accused of a crime that would of put you away for life. You sit 6 months .you go to court finally . The courts ruled in your favor, then you sit another 6 months waiting for a parole hearing. Again they rule in your favor. Parole.s judge rules to have your parole back to the way it was before. You finally get out to have an ankle braclet on, why? Not the judges orders. More rules were added, again not the judges orders. Very confused

Can I just ask why a probation officer would tell someone's relatives that are happy with the prisoners progress and they have always thought the prisoner is genuinely remorseful and tell the prisoner himself if he does this course, that course and what ever other courses and keeps his head down for 6 months then his HDC will be looked at and then his tag is refused due to probation not 'backing him'! Probation made it out like he wanted to help and then stabbed him in the back after he stuck to all asked of him down to the letter! Now he's coming out of jail at his normal release date only to have to go in a hostel only god knows where as well as having no job now as his job has been on hold for 16 months but now his HDC has been refused it can't be held any longer! I agree with everyone that says they aren't to be trusted, they act like they are helping you when that's all an act to get prisoners to do as they say through giving them false hope of early release! I know a lot of people see it as prisoners should be punished and shouldn't get early release anyway but it is possible for them to turn their life around and use their time to reflect and improve on their past!! This man now has to come out to hostel conditions, no job and a girlfriend that is clinically depressed with the stress of being told different things constantly due to the probation officers dishonesty! She's struggled all this time to keep the family home going then to think its finally over only to be told oh no actually it's another 3 months until release and then another 3 months in a hostel and also she'll have to support him as well now seen as he hasn't got a job now!!! It wouldn't be half as bad if they were up front from the start and just said "this is how it's going to be........."! Even typing about the situation makes me fuming!

    1. It's always difficult to comment on any case without the full details, and that is not a good idea on an open forum like this.

      There must have been a good reason why HDC was not supported and I would hope that was explained to the client. Are you sure it was a case of the PO not supporting, rather than it not being possible due to the nature of the offence or offences?

      It seems likely that there were problems with the home situation for a hostel to be considered - a decision not taken lightly given the difficulty of finding hostel places.

      I suspect that there were elements of risk involved in this case and it was probably a mistake for the PO to have built up false hopes of HDC when it might never have been likely, if indeed that is what happened. Possibly the client wrongly thought that HDC would be possible if they did all the courses etc?

This is what happened to my son hes done 6 months hes due home probation for another 6 months judge restrained him from a certain street his home is in the area but not near the street his po said he had to find a diffrent address which we did still not suitable as in same area still so we have a new address out of the area still trying to put him in a hostel miles away from his family even though his po had said just out the area would be good enough hes very depressed suicidal can his po keep doing this ??

  14. thank you for replying,its definately his probation that is the cause of him being turned down, they have said that his home address isnt suitable due to it being his address at the time of the crimes and his arrest but for goodness sake what is he suposed to do? give up his home (a home that is infact his partners family home of 20 years and we now rent of her family) give up all the hard work they've put into making it theirs! the house is in a nice area, its private rented, yes it is in the area in which his has known associates but how is he meant to prove hes changed and doesnt want anythin to do with those people anymore when he isnt given the chance? his partner has a good job and he has a supporting family! its not as if hes a drug addict thats being released to nothing and is certain to go back to crime! i just dont find it fair at all! He has been given a high risk assessment but again this doesnt seem fair given that hes in prison with men who have multiple of the one charge he has (and its his first) and they are medium risk. this probation officer just seems to have it in for him and has done from the start.

I have a power mad probation officer that is making life difficult for me and i believe is a disgrace to the probation service... i have a court order specifying that contact with my daughter has to be supervised, nothing more yet despite myself and the mother wanting my father to be that person my probation officer doesn't deem him suitable because he was in court to give evidence and she has threatened that if we allow it she will breach me?! Can she really do that? Several solicitors have advised that as long as i stick to the order she can't but she insists she can and is making life very difficult and confusing! She clearly has very little if any concern about my daughter who misses her dad and has been through enough already. Are you able to help with any advice on who's telling the truth? Her or at least 4 solicitors?

    1. It's always extremely difficult commenting on cases in the absence of full details - and that would not be appropriate in an open forum like this.

      I think my suggestion would be a solicitors letter to your supervising probation officer setting out a case for your father to be present during supervised visits with your daughter and requesting reasons in writing if this is not felt suitable.

      In the end I think the Probation Officer will have to seek expert advice from the solicitor acting for the Probation Trust and the matter decided by correspondence.

  16. Can a probation officer have an affair with an ex young offender that they have purposly kept their telephone number and keeps visiting them years on and sending the ex young offender sexually explicit text messages

    1. On the face of it this sounds like serious unprofessional behaviour and if a complaint was made I'm fairly sure it would result in an internal disciplinary enquiry.

  17. I am on probation for a felony owi. I was violated in March of this year by my then PO for not going to my probation appt. Long story, but I deserved the violation and paid dearly for it. Early oct I was pulled over and now have to go to court for a driving on revoked and have a different PO. I have remained sober and completing the terms of my probation, looking for work and being a mother to my two young kids. I have not been driving but did that day. It was my mothers car and I was dropping my daughter off to a birthday party 2 miles from my house. I have not told my PO because I'm scared of being violated. It has been so hard trying to get our lives back after the last owi in 2011. What will happen when I tell her? Should I have reported this sooner?

    1. Thanks for getting in touch. Judging by the offence of 'felony owi' I'm guessing that you are a citizen of the United States. The equivalent offence of 'operating while intoxicated' here in the UK would be OPL or driving Over the Prescribed Limit. Both are quite serious offences, depending on the circumstances and degree of intoxication involved and any repeat offending will naturally attract higher penalties.

      As a general rule I would naturally say that informing a probation officer of any change in circumstances or new offence would invariably be the best policy - there needs to be a degree of mutual trust and respect between officer and client so that any sentencing court can get a fair picture prior to any new punishment being imposed.

      I must pick you up on a key bit of distorted thinking on your part - "I have not been driving but did that day". Probation Officers hear this sort of thing quite a bit - you should not be driving at all - not even once or doing something wrong a little bit! I'm sorry but you did drive you did get caught and the assumption will be that you carried on driving many times and did not get caught.

      Having said all that, clearly I do not know all the circumstances of your case and you live in a foreign jurisdiction. I hope things work out ok for you, that you learn from past mistakes and that being open and honest with your Probation Officer will prove the best constructive course in the long run.

  18. Hi jus wondered if anybody could help me.. My partner and the father of my son is due to be released on HDC (tag) in four weeks but has told me that probation officer advised him not to put my address down as he has never lived with children and haven't had this property long however it is my permanent secure council tenancy property (forever home) so thus advised him to put his mum address to obtain tag???? Is this true do you have to live somewhere before or the person to have lived there long? And to have lived with children before even if the child in question is his son????!!!!! Please help

    1. Hi there,

      It's always difficult commenting on a case without full information and it would not be a good idea to share too much here on an open website. In particular I obviously do not know the details of the offence or offences that led to a prison term and whether they might affect a decision to grant HDC to an address with children.

      Having said all that, I think I would suggest you try and speak to the officer concerned. If your partner decides to carry on putting your address, I'm pretty sure the officer is duty bound to visit you and discuss the matter, including any concerns they may have.

Hi my disabled son had a domestic with his girlfriend back in 2013 she took out a molastion out against him She then decided to set him up makeing sure she went near my son on purpose then phoned the police he was arrested and sent to prison for five weeks He was put on probation for two years these probation workers have put on a third level mappa ? Also my son had a care package probation have been to the office of this carers company and told them that my son is highly dangerous They have even wrote to soical workers to have them visit my sons neighbours to tell them how dangerous he is also a danger to children my son is severly disabled and loves chilren as he as two little girls of his own there even stopped him from seeing his girls my son as attemted to take his own life on a number of occasions please how can these monsters get away with they defeatful millous lies ?

  19. I know this might sound crazy but I have just served a life sentence for something I never done and I am not coping mentally really depressed I am scared to let my pi know this in case I get recalled is this possible jim

    1. You don't say how long you were in prison, but in the majority of cases it will have been a long time and coping upon release is no easy task. I'm hoping you know your PO well and you will not be surprised to hear me say that my advice is to talk things over with them and share your worries and concerns.

      Recall is a big step and only really considered if your situation or behaviour has changed significantly and therefore might give reason for concern.

      It could be that you need to see your GP and discuss with them the fact that you are really depressed. It might not necessarily mean medication, but rather some one-to-one counselling. Again, your PO will be able to advise on this or possibly arrange some community support for you.

  20. Been on probation for 2 years now and think the whole organisation/disorganisation is a farce! After meeting my Om from the word go he was ok until he got me confused with someone else! (another person that has the same first name as me not surname) how can we trust you if you cant tell who's who? Complained to my solicitor about it who in turn tried to get in touch with him but couldn't surprise,surprise he is now a manager of some sort lmao this person is a liability and may i add one other thing since then about a year and half ago i lost all hope whilst being on the said disorganisation and my probation officer is no help at all! Moral of the story is these people/robots are not to be trusted at all! Why has my old om been promoted? I just walk away scratch my head and think what!!! Are you lot for real laugh to myself and look at the building shaking my head!! Complete joke!!

    1. I'm sorry to hear about your experience with your OM. You don't say if they were a PO or PSO but in this world the reality is that there are good, bad and indifferent people in all walks of life and you may have been particularly unlucky.

      Many of us try very hard to do the best job we can, often in very difficult situations, and I can only say I'm sorry your experience has not been more constructive.

Can you give me info on whom to complain to? I believe in sorting situations head on but it has proved useless don't want a po who is absolutely useless doing nothing for me at all!

    3. The first step is to find out who the PO's line manager is - it's normally a Senior Probation Officer or they might be called a Team Manager. Write a short letter to request a meeting saying there is something you are not happy about and would like to discuss with them.

      I'm sure a meeting will result, but should it not for any reason, write to the Chief Executive Officer at Head Office explaining what has happened and that you want to complain.

      If any of that fails for any reason, come back for a bit more advice. Hope things get resolved for you - in my experience they nearly always do.

      It's open to any client to request a change of probation officer, but there must be good reason and it has to be endorsed by senior management.

      I must tell you that it's rare for requests to be granted due to the fact that the relationship between officer and client is quite likely to be tense sometimes due to the nature of the job, but if a request is made in writing, it will be explored by a manager.

      My suggestion is that your husband tries to discuss the problem with the officer concerned first and only if matters can't be resolved, take things further.

  22. this seems like a question I can ask the people here I have been a heroin addicted for 18 years always in jail or prison got on methadone 6 months ago since then I have held a job going to college full time pay my bills take care of family etc living life gave a dirty test oops then told I have to get of methadone well that's the only thing that has worked since I was 14 years old can she legally do this or is it a violation under disability act and rehabilitation act I don't want to go back to hoe I used to be and I knopw when I get sick from coming of the methadone in 21 days from 85mg to 0 I will get strung out any ideas

    1. I think many of us would share your amazement and disbelief! Research and experience tell us that people addicted to heroin, especially for the length of time you describe, on average 'fail' at least 10 times before being able to cooperate fully with treatment.

      From what you say it appears that trying to discuss matters with your probation officer is difficult, therefore I would suggest that you request to see their manager in order to explain your point of view. You seem to have the support of the drug worker and I hope the decision can be reviewed.

I can honestly say that i hated my po at first.he was calist and very agressive on dealing with me.my first impression was this guy was gonna crusify me .i had a seriouse problem with drugs that was destroying my life.his aggresive tactics of yelling at me and sending me to programs and threatening me with jail was a true wake up call and shocked me into doing what was had to b done to get my life together.i now can say i am truley greatful for this man forceing his way into my life he may have saved my life.he still thinks i hate him but this is not at all how i feel.i wad honest with him from the start with my drug problem and he was brutally honest with me and it helped me and im greatful now .

    2. I was given a 9 month referral order with 27 hours community work. I left my parents home because of continual rows (although we get along now) my YOT worker was kept fully informed of my new address. I was breached and the YOT worker told the court she did not know where I was living. Fortunately the Judge listened to me and believed I had kept her fully informed. He reduced my order to 3 months which infuriated my probation worker, she now insists on sending all letters and appointments to my parents address she has just sent a final warning because I did not attend an appointment what should I do

  25. i have been promised that i had a job when i filled out a form on craigslist and was mail a check i cashed it not knowing that it was fake months latter i had a federal warrant for my arrest and was trailed as guilty i have never done anything bad maybe went over on my checking account a few times but never this i am so depressed and sick at that i don't know what to do i have deferred adjudication 2 years and pay every month i am going thru severe depression

My son is newly released from 1st prison sentence after serving 2 1/2 years for GBH while on drugs & drink, he attended all alcohol & drug awareness courses when in prison, probation pressurised me to have him home, "after all it was his first sentence" first 2 weeks home perfect, now he is a drunk & back to his old ways smoking weed, why do probation appear to do nothing? & yes I have told them

    1. I'm sorry to say that it's not that unusual for a young man released from prison to return to old patterns of behaviour, especially if mixing with his old associates and without employment. That is no comfort I know, and probation don't have any magic wand to wave. Sadly set backs are to be expected, despite everyone's best endeavours. All I can suggest is that you try and work with probation and any other agencies in order to encourage your son to change their behaviour. I hope things improve, but it may take a long time unfortunately.

  28. This makes me laugh. I had a video conference with a probation officer and afterwards I found he had completely fabricated what was said and discussed. After release I got a DPA Subject Access and found my current one was writing wild and inaccurate things in my file - going even to claiming meetings and discussions which never took pace (proven).

    I am new to all of these situations, and I do not know who to ask for an immediate and helpful answer.
    I live in Calgary AB, I am currently on house arrest, and from what I understood, I had permission to go out for a four hour time frame every day and look for a job. I applied for many jobs, but I always received a negative response. I am now feeling insecure because I do not understand if the rejection is based on my past or my lack of education ( I do not read or write well, a friend is typing this for me). So I decided that I would rather dedicate my time to attend school, and get some education, instead of hopelessly looking for employment.
    I have never breached my house arrest, and the past week, I was not attending class because I was sick, but I did not leave my house either. When I started to feel better, I got up and went to school and request any assignments I had missed, so I could catch up, and while I was out, the police came to my house, my wife told them I had gone quickly to school, and they left. They did not return. I have tried calling my P.O and he is not responding. My wife said to me that the police had asked her if I knew that I was not aloud out. But to my knowledge, I was, IF it had to do with education or employment. I want to write a letter to my PO and explain my breach, but I am lost. PLEASE HELP!

  30. How would one instigate misconduct proceedings against a PO ? My previous one lied blatantly, reported nefariously, amongst other things...and caused me and my family so much hassle and pain (still ongoing). She made sure I got a heavy sentence for my crime and im still paying whilst on licence for the next 20 months. More importantly, my family are still suffering pain and distress from this.
    I have received info under DPA SAQ etc and I have other forms of proof of lies and misfeasnace.
    This woman is a danger and should not be a practicing PO.

  31. I have met some probation officers that truly are helpful. One of my friends has such a PO, who is able to use both authority and discretion. It seems to me that there are times when it is appropriate to be hard-nosed and another when a social worker approach is needed.

    Unfortunately, neither of the two I had. The first one was removed after I had been violated and a letter she had sent to the judge, upon cross examination was found to be entirely fiction. The second one truly is foolish. What is amazing is that neither of those two attempted to build rapport with me. My background is in the behavioral sciences so I am aware of some of the techniques, or at least the appearance of being genuine that encourages rapport with the client.

    I am also astounded how poorly they are prepared and how bizarre is their thinking. I won't relate examples here as am still on probation and that may identify me. My recommendation to how to deal with a PO is to begin from the position that anything they do is not going to help you. As they reveal themselves to be genuine and a reasonable human being, they you can assume another posture.

    I made the grave error, as I did when the first and only time I went to prison, was that there were people to help me if I obeyed the rules. I lost my innocence when was over the age of 50. So now I take a different tack. I take whatever skills I have--reading people and intelligence--and make it work for me. If you are fortunate enough to have a PO that indeed wishes to reintegrate you into society, then I would advise to work well with him/her. Those are usually the ones who are quite bright. But if you have a "guard" type, they usually are quite the dullards and are easy to redirect.

    One last comment: There is a definite difference between those I consider "officers" and those that are merely "guards" or "thugs". What type do you have. Answer that and conduct yourself accordingly.

  32. I plead guilty to a felony on aug 25 2014. I have 18 months probation. my question is on my paper work it says live with parents and abide by rules.. im 31 years old have a house and am married with 2 kids.. the only thing I can figure why the judge put that down was because my lawyer said in court I have family there to support me and if need be could live with them. as this was my first time being introuble and taking a plea deal I was kind shocked by everything and never heard the judge say for me to live there but he very well could have and I just didn't process it... what can I do to change my address with my probation officer snice my court papers say that. also me and my mother don't tend to get along with one another for more than a week

I've applied for disability and got denied the first time.so I had to reapply and I am currently waiting on a decision. But I can't afford to pay anything right now. Hi, so have a couple of questions im having a hard time finding any info online, so first off my fiancee has a warrant andhis p.o does not know he lives with me because we have a no contact order on a felony case, my first question is what extent will his p.o go too, to get his address? Will he look at his tax returns? Or bank accounts? What can he find out? Also his p.o has no record of his jobs since his release. Should he contact his p.o? Will his p.o be able to find this info out? Or will he wait for him to get caught? We have 8 years left of probation. Also I have one more question so this no contact order was set on him by the courts and he only gets in trouble of cought with me I dont have a no contact order, so my question is is there any way he can get it lifted before probation is over?

    So I have one last question about me so I took my ua and it came back diluted with traces of maryjane, and I have to go re take it, so I cant help having diluted urine I get severe migranes if I dont drink a lot of water my doc says my body gets dehydrated fast, what do I say to my p.o, and when I go in will they do a rapid pannel? If my test were to come up dirty again would I get arrested on the spot? Because I work and I would need time, would they still fail my ua because its diluted if I cant help it? Also I got a letter with my appointment date and it says if you fail this test more then once it could result in 48hrs jail time.

    I wonder if you can answer my question.

    I have been on probabtion for over 2 1/2 years now and have never had any complaints from probabtion, Infact sometimes I don't see my officer for 6 months as she says she really has no concerns with me at all.

    I have recently been offered the opportunity to travel with work this year as we are an international company. This would mean 2/3 days in Europe every 3-4 months. As part of my sentence plan she has suggested that I get a higher paid job and this will definitely get me that.

    However I am really nervous about approaching her (even though she is really supportive) the first trip is in a couple of weeks and I really need to get the ball rolling if I want any effort in going. I have read the NOMS documents about the 6 questions that probabtion should answer and if they are satisfied then it shouldn't be a problem.

    I feel as though my progression is at a standstill and if I don't take up this opportunity now then it won't be there in 2016 when I come off license. And I certainly don't want to leave the country and be recalled.

He is four yrs younger than me I'm 20 and he's 16 and his mom is okay with everything...but I lied to my probation officer about who I was with I told him I was single because I don't feel he needs to be involved in my personal life as long as I'm doing what he asks and am passing all my drug tests, my p.o is kinda always negative even tho I do everything he asks me to do, and he always makes me feel so small, but I was just wondering can he tell me who I can and cannot be with? My bf is not a felon he has no criminal history, he doesn't do drugs...can I get in trouble for losing?

    1. Generally speaking, it's not a good idea to lie to your probation officer and yes they have a legitimate interest in your personal life I'm afraid. However, I must repeat that probation differs quite a bit between the United Kingdom and the United States.

      Your reference to 'felon' makes me think you are based in the States and I regret I'm not really qualified to comment on the situation in your country. I'm sorry about that, but hope things work out for you.

    1. I think a meeting with your mother might well be a good thing, but you must decide and let your officer know. In the UK you could decline the suggestion if you wish, but I suspect you might be based in another country as you mention a meeting every 3 months, which would be pretty unusual here in the UK.

  39. Hi i need advice on how i can prevent my partner leaving jail and going into a hostel. I tried ringing the area manager to be told quite bluntly thats he would not discuss my partner with no one but him him nut i just need someone to hear my reasons for him not going there. i will give you a quick run down on whats happened.
    he was in jail for production of cannabis when i was burgled he got out on tag 6 weeks later we spotted the person who had broke into my home when i was at work my partner followed him nd got close enough for me to ask him to pull over. He didnt so we went home that night police arrested us both for threats to kill because of my partners previous record the police believed every single word and charged us both with threats to kill and my partner dangerous driving as well. my partner was remanded and me being a nurse i was suspended on reduced wage. We pleaded not guilty because we really were innocent. At court without my knowledge my partner accepted a plea bargain the prosecutor said if he went guilty they would put forward no evidence towards me and i wouldnt be charged. He went guilty was charged with threats to kill and dangerous driving his licence was revoked. none of this was true i was furious there was no evidence at all to suggest we had done anything wrong. we both got a restraining order to prevent harassment also.
    my partner was about to start work the monday he went back to jail i had to beg his employer to keep his job until he gets out in march he said he will on the condition he doesnt go in a hostel because he needs all his workers at his house so the leave to arrive at the site at the same time various starting times depending on where the job is and he starts work th day after he gets out. Also ive struggled on for 14 months unable to pay mortgage unable to pay bills i have promised my bank that in march when my partner is home i will be able to pay the full amount each month their response was if you dont we will start repossession procedures ive already had my car repossessed. my partners probation worker said our home is not suitable as i was co offender but this is our home i have managed to keep the roof over our heads for as long as possible the stress of money worries has made me ill i am still suspended from work hoping to go back after new year but thats still only one wage coming in until my partner comes home we cant get our lives back to normal. this is the longest he has spent in jail he has changed so much it has devastated him being in there this long but he would never express this in front of his probation worker he goes all defensive and they just see a re-offender with an attitude problem.
    i need help but do not know where to get this from basically if he goes into a hostel we lose our home he loses his job

    1. Sorry for the time it's taken to reply. Obviously I don't know all the details, but I understand what you are saying about it being a different relationship. Unfortunately nowadays there is a culture of erring very much on the side of caution with many officers unwilling to be seen to take any risks. This is being done in the belief that you will be best protected, together with any children. I know you see things differently, but try to see that the intentions are honourable, but can be viewed as inflexible.

      I suspect that whatever well-reasoned arguments are put to them, it's going to be very much an uphill struggle, however I would suggest that a letter to the officer, or their manager, explaining the situation might help. I think your partner would do well to write a letter as well.

      I hope things work out well for you both in the long term.

  43. Hello Jim. I am an employer in customer service with a current employee under house arrest. The employee was with me before he served his time. He is 100% of my work force. The employee has been on house arrest for a month now and he and I are having issues what seems to me as a incompetent parole officer. I assumed there would be some "kinks" to work out. After a month the officer has yet to talk to me after multiple phone calls to him by myself. During this past month my employee missed several days because of the officer. Now after a break for the holiday the officer is doing it again because he did not change the hours of work for the employee. Once again I'm doing damage control. I've been considering releasing my employee because of this. Any thoughts?

However, my feeling is that your employee would need to give written authorisation for you to talk to the Parole Officer about their case. I hope this will enable a dialogue to take place and give everyone the opportunity to explain what the situation is without breaching confidentiality.

    I have been reading your blog with interest!

    I have recently begun a relationship with a man with a criminal conviction. He sees his PO every month. He's in paid employment and has good solid family support. He's turning his life around.

    My parents have suggested that I could meet my boyfriends PO, which my boyfriend is ok about.

    But what would I ask? Would my boyfriend have to be there?

    Also he cannot apply for a passport for 5 years,, a condition on his licence is this fixed in stone for the whole 5 years? Or can it be reduced?

In doing so though I think you would need to discuss with each other what the purpose of such a meeting would be? Is it out of curiosity, a desire to be of help, or to gain information, possibly about the offence or criminal history?

My brother who has mental health issues and is disabled was eligible for early release from prison just before Christmas (tried to commit suicide by setting fire to his flat) For three weeks prior to his release his PO continually badgered my elderly parents who are both in poor health to take my brother in. On Christmas Eve his PO bullied my parents and took advantage when my dad became ill during the conversation with a severe angina attack and told them that as they were his parents they were responsible for my brother and they had no choice but to take him in - she was putting him in a taxi and sending him up and that was that!! (my brother is well over the age of 18 btw). A few days later my dad took ill again whilst trying to arrange a Social Services assessment visit for themselves (on the advice of his doctor) which culminated in the police arriving at their home. The police contacted my brother's PO and my brother was told to be at their office first thing the next morning for a meeting to sort alternative accommodation for him. As there was no form of transport to get him there in time (the PO was informed of this but wasn't interested) my parents had to pay for a taxi to get him there. When he got to the meeting the accommodation had been given to someone else and my brother had to go into a B&B which my parents had to pay for. A few days later when the money had run out his PO (different one as the original one had moved offices) contacted my parents again and tried to bully and harass them again into taking my brother in - "...it's the system..." is what they keep saying "...you're his parents, so you're responsible..." She was putting him in a taxi and if he didn't go he would be making himself homeless. (My brother didn't turn up as we have since found out he had to be taken as an emergency to hospital instead!!) Both my parents are now very frightened and anxious and feel they have been bullied and intimidated and forced into doing something they are not able to do - that is be responsible for my adult brother!

    I understand Probation Officers "...manage offenders in order to protect the public..." Where's the protection for my parents??

    1. I must say I find this story very disturbing, but commenting is always difficult in the absence of full details, and that would not be wise on a public forum like this.

      Finding suitable accommodation for clients coming out of prison is always difficult, but especially so if there are issues of mental health and disability. It is completely wrong for such pressure to be put on elderly parents and I would suggest that they are helped and encouraged to write to the Senior Probation Officer of the office involved, outlining the situation and requesting a meeting to discuss how their son can best be assisted.

    2. Sorry for the delay in responding. I did speak with the Senior Probation Officer and sent in a letter detailing our concerns. She did respond in writing with a sort of apology but apparently neither officer involved was aware they had caused any distress!! They have however agreed not to contact my parents in future so hopefully that will be an end to it.

    I've just finished reading your blog, and I have to say that it's a very good read, as well as very insightful in today's law system. I'm afraid to say that I, myself am on probation and restitution, and was given a very rude wake-up call by my probation officer last week. I went in to report to him every month as I am ordered to, and was met with some very peculiar behavior. He decided on that day last week that it was okay to inform me that due to a mistake I've been making when filling out orders to pay for my restitution, that instead of the money being re-issued to me so I may try again, that the department has instead "placed my money on suspension" until he can confirm that it's mine. Now, the system generally rules that if my payments are three months behind, I am liable for a court summons, and could potentially go to prison. This puts me back by SIX months! And on top of that, as I'm trying to request a chance to see him again so I may attempt to set things straight, he comments about me "seeming to be a half-intelligent young man". I won't lie when I say that I was livid and I wanted to deck him, but of course, I held back. Do you maybe have any advice as to how I can handle this? Because as I've already told some of my friends and relatives, this kind of thing is just downright shady.

      Being based in the UK, I'm afraid I don't know anything about the payments you mention, so can't really offer much advice, beyond saying it's almost certainly a wise move not to have 'decked' the officer.

      The only other suggestion I would offer is to write a cool, calm and business-like letter to the officer's line manager stating your concerns and requesting an explanation.

  47. Hi! My partner is soon to be released on licence after serving nearly 17 years in prison, he was 17 when he went in and although he is definitely ready I'm concerned that he will not get the practical help and support in the early stages.
    He is having to be released to his home town which he didn't really want, the crime took place there and his childhood was messed up, he is hoping to be transferred back to the area where he has a close network of friends and support.
    Until than he'll have almost no one who will be close by to help and be there should he need it... I'm just really worried as at times already he finds things we take for granted overwhelming.

  48. I find this both confusing and worrying. 17 years in custody says to me your partner is serving a life sentence and hence coming out on life licence. In my experience, very careful consideration is taken by the Parole Board and now NPS to make sure release and resettlement are carefully managed in such cases. I find it hard to comprehend that there is not a robust and well-thought-out release plan in place.

    1. Your right about his sentence and licence and in ways I'm sure they have thought out a release plan that takes into account many factors but he wont find out the full details until 3 days before his release to the hostel.
      From what I can see everyone who's worked with him, his probation etc. have been great, it's just there just hasn't been a great deal of practical preparation or communication before his release which I find strange for someone who hasn't had to deal with the reality's of being free for so long... apart from work release.
      My partner went in an angry teenager and has grown into a man who wants to " get it right" so much, who has gained the respect of the people who have come to know him over the past few years.
      He is so happy to have been given this chance but he's also scared as it feels as if he's coming out to things and system that he doesn't know or understand... the most basics i.e. benefits, how to open an account without the things most banks want, driving licence, passport... these things should have been explained to him before now.

  49. I have a son who is on felony probation. He is doing well and working and doing his best to find his place in this world. With him working many hours, he finds it hard to make it to community service. The driving distance is an issue as well. But, this is his situation. A few months back he was told by his probation officer to not leave a job site early even if the person in charge let him go, ( due to lack of work). Today, he was about 10 minutes late and was left. His probation officer sent him to an alternative location. Before my son got to the location he received a call stating the van was coming back for him. Long story short... he was told that he would have to go before the senior probation officer later this week and all his hours today were null an void. He could be facing a 2 year prison stay for this! He was told from this Senior officer months back if he had to see my son again he would send him to prison.
    My question is.. can my son be sent to prison for this? He did show up for c.s. and was willing to do the work but since he went with the other crew he apparently defied his p.o.'s authority..

      Unfortunately, being based here in the UK, I have little knowledge about how Probation works in North America. All I can suggest is that you help your son explain in writing what happened and address it to the senior officer. Alternatively it might be wise to seek legal advice.

    I would be grateful for your opinion on the following.

    My son was on licence having been released half way through a 3 year
    sentence for possession with intent( v small quantity). In December 2014 he and his partner had an argument, both were drunk. She called the police and immediately regretted the action. They arrived and although there was no
    indication of violence, and the 'victim' refused to make a statement, a
    DVPN.was issued. This was made into a DVPO in the magistrates court,
    again in the face of opposition from the victim. At the time of the incident the
    police also found a small quantity of an unidentified white powder, less than
    2 gm, at the house. This did not belong to either my son or his partner. As a
    result of this my son was recalled to prison for 28 days
    At the end of this period he was told he could return home,a police officer visited the house and confirmed that his partner was more than happy for
    this to happen. However, when he reported to probation he was told that his
    licence conditions had been changed to prevent him having any contact or
    living with his partner until the expiration of his licence in May.
    He has therefore been homeless since January with little or no support or advice form his offender manager.
    No charges were brought for domestic violence and no charges for drugs (
    Tests came back inconclusive for cocaine).

    His Offender manager also blocked his enrolment in the Bridge project for drug users. Telling them he had been arrested for possession with intent.
    When he asked her if, in view of the lack of charges, his licence conditions would be lifted so he could return home, something his partner had endlessly requested, he was told no. When he asked why she had lied to the Bridge
    project, she refused to answer and said she would not longer deal with him!

    His record of attendance at probation had been exlempary up to the DVPO
    He is still in a homeless hostel, in total despair, no work, no prospects.

    I feel strongly that he has been let down by his PO, whose actions seem vindictive. She has also committed an number of other highly questionable actions, such as discussing other cases with him and talking about him to other offenders.
    I would like to make an official complaint but, as his new Manager is a close friend of the previous one, he feels he will be put into a worse position, as he thinks they are just looking for an excuse to recall him again.

    1. Sorry for the delay in responding. It sounds to me that you need to put some of your concerns into a letter and send it to the officer's line manager and request a meeting. Depending on how that goes, it might be appropriate to then consider whether an official complaint is warranted or not. Hope things work out.

    I was sentenced to one year split sentence, 6 month at a camp prison and 6 month house arrest with the feds, following 3 years probation.
    I finished both the 6 months camp prison and 6 months house arrest, now I have completed about 16 months of my 3 year probation.
    I tried a lot looking for a job, no luck what so ever, I have paid off my restitutions in full, I have never failed a UA, I have never got into any trouble at all, I have gotten my GED while on house arrest from a community college. I am unemployed as of right now, living with parents.
    I do got money from selling my business last year, so while I'm looking for a job I'm just spending that money.
    I sent my PO an email telling her about all this and pointing out every detail professionally and in short words right to the point, and pointing out that I am going to look for an attorney to look into my early release and getting off of probation early. I need to get my life back without a probation. I also pointed out that once im off of probation I want to get my only felony expunged. my PO only come to my house visit once every 2-3 months, at first i was on a random UAs by calling that 800 number with having a color. but 3 months after i started my probation she called me and said i no longer have to do UAs.


    So please I need help; what is my chances of getting off? What steps do I take? Who do I speak with? Should I or not talk to an attorney? I am not doing anything wrong at all, but I swear just the thoughts of all this (jail, prison, probation, courts ect...) makes me nervous is that normal?

    My daughter is on hdc at thd moment and is complying fully witb her curfew and working with her PO, the future looks positive, however the tag box goes off so much and each time she has either been in bed or in tbd bath, I am scared she will get recalled for a breach when she doesnt deserve it, how reliable are the tag boxes and could she insist on having the tag company at least come out and test the equipment?

    1. What you describe is not uncommon as the tagging devices currently used are very unreliable. Just make sure all false alarms are reported to the company and a note kept of times etc. It might well be worth asking for the equipment to be tested, but I fear it is just a symptom of a crap system.

  54. My fiance had a choice to make that was supposed to be his, and his alone. He has been at a residential treatment center, for 30 days now. Wednesday April 22, 2015. at Drug Court he was told he had a choice to make due to a 30 day extension. He could choose to accept the extension, or not accept it and come home. No matter what, the decision is his. The judge himself, said the same thing. Later that day, David called home, and he told me that his P.O. called, and told him if he chooses not to take the 30 day extension, she could violate him and terminate his probation, but she doesn't want too, she was just letting him know that she could. So of course, not wanting to get violated, my fiance said is going to stay until they tell him he can come home. Not once did anyone, including the judge told my fiance that his probation could possibly be violated if he did not accept the extension. So please, someone please tell me how the hell my fiance had a choice to make of his own? She threatened his freedom, so he would not leave! What can I do about this B.S.?

    Please could you help ? My Husband has Mappa involved for a start, not a lifer. The problem we have is that we want to live together and probation are saying no all the time, He is in a different area to me but every time we request a place where we can live together it comes back no. He is on Probation, His father died when he was in prison and although now released has been told he is not allowed to visit the grave , no reason given, He has not been to see his mother, no reason given, so he has not seen her for almost 3 years now and she is poorly,we are both given different reasons on the rare occasion when a reason is given. He still has to ask to be able to visit me. He is no way a violent or abusive man. He is past middle age and partially disabled. I have tried to move to another area but it still came back no. My house was approved by probation in both counties but then refused. I am at my wits end as I've even tried a solicitor to get advise but no one gets back to me to help. I am almost a pensioner myself. Please help. Thank you.

  60. My best friend's probation ended in January of 2015, however he has not received his paperwork that must be signed and returned to officially clear the charges. It is now June of 2015, and the paperwork still has not arrived. He calls his PO almost once every week and emails. She says that she doesn't mail it and all he can do is wait for it to come in the mail. She always says she will check into it, but nothing ever happens. He can't move on from his mistakes and start his life until he receives the papers. What can he do?

    However now my PO has decided to make me an appointment, at the place I can't go to, and has decided to BREACH me because I didn't go...which she knew I couldn't.

    Is she in the wrong, and what can I do? She is trying to have me back in court.

  65. Some one told my Nephew he can't get his license's cause he is on Probation. I think that is kinda Stupid to tell a young kid that he can't have that cause he is on Probation. It is like they are telling the kids lies. Their is no rule in the Probation they can control the rights to Driver License's for one kid to another in all the states around. So how can Probation officers tell that to someone when they do not Control The DMV when that is a STATE issue not a County Issue.

  67. Hi, Jim. I would like to know how to complain about a probation officer. My brother is out on licence for 8 years. When he came out I will admit he did jump straight back into the drugs. a months ago he decided it was time to change his life around. He asked for drug testing every week so he could prove he was clean and also got a job.
    After stopping the dugs he started drinking, so he asked his probation officer for help. He felt he might have a mental health issue as well. Also the probation officer did was send social services around. They decided the kids were all ok so no need for any help. This is someone who has never asked for help before!
    He ended up going to the doctors for help who refurred him. Turns out he does have a mental health issue and they are treating it. But I'm upset as it wasn't the probation officer that helped him.
    When he was released he did say that over the years he had made a few enemies and asked to be put on tag and have cctv installed in his home. Which did happen.
    The other day he was in a friends car when another car was cutting them up and flashing their lights at them, he got out the car and was faced with a gun pointed at him. He was shoot 4 times, twice in both legs, shattering the bones in his legs.
    He was back at home resting when 10 police officers turned up. His probation officer was sending him back to prison. At the moment he can not even walk. The police had to carry him out of his bed into the van. He has not been arrested for anything as he was the victim and he hasn't gone against any bail conditions. I have been told she has sent him back for "bad behaviour".

  68. I have a question. Why do some probation officers let cerian people get away with violations while others with the same officer can be threatened at the first miss payment? Yet some people get away with hardly ever paying their probation or restitution. I seen the thing saying this woman was going to violate this person for several violations and he didn't even show up for his date yet he's still free.. I even wrote an affidavit to other things he had done like smoking weed and parting which are all violations but yet she's done nothing to this man. Why? What can I do to report her for letting this go?

I have a question, I really have searched everywere for an answer with no luck,, my boyfriend is on probation in the south, and I live in the north,, he is homeless right now, he asked po if he could move his probation to my county, his po called me asked if I confirm this,, I did, and said she will speak to the relevant people in my area and arrange this,, meanwhile,, my boyfriend cannot just come to me we are about 6 hours apart, and if he misses probation well we all no what happens so we are in limbo....does anybody know how long this normally takes? Eagerly and desperately waiting on a response,, p.s I should of asked the officer when they called but didn't think and now its closed for weekend

  78. Hey I was just wondering how much my offender manager knew about my crimes? I won't go into too much detail but I did commit my crimes and I am very ashamed of them. I am being completely compliant with probation but my om keeps making sly comments about CCTV she has seen of me in the actual police station?? Is this possible or is she just trying to get some sort of rise out of me? So I guess what I'm asking is how much knowledge do they have on our offences and would they have access to such evidence?

  79. Hey jim, git a question for ya. I was on probation for about 3.5 years. They keept changing my po. The last time they did I had a month to go or so I was told. When I meet with the po she confirmed I was no longer on probation after our meeting. I left. 2 weeks later she said there was a mistake and I have 3 more years of probation and that I'm back on it. Isn't there something I can about this? I went from homeless to married with a kid, own a house, have good credit 2 cars ect ect seriously could write a freakn book about me and yet I feel like I'm going to throw it down the drain because I'm sick of the government and it's inept employees playing with my life. What can I do? I'd appreciate any info. I haven't responded to her yet. Was wondering if I need to go into her office with a lawyer.

May son was due home in sept from a hostel, after breaking a restraining order, (in fact he didn't his girlfriend went to his house) on the morning of his leaving he was arrested and sent back to prison for another 12 mths. I managed to get all the papers from him, even though by the time my son received them it was too late to appeal, it was stated that he hadn't broken his order but the PO (who had only took over his case 5 days earlier, and who had never met my son) decided he was a danger to me, his girlfriend and the public. I couldn't believe what I was reading. I think all P.O stink its obvious why he was sent back as it would have cost a lot more MONEY to have put risk assessments in place and give him the support he needed, this way the cost is down to the prison service. Most PO are power mad and their attitude is 'I'm it and your shit' my son is now suicidal and has a history of self harm etc. I've written her a letter telling her I will sue her personally and the probation service should anything happen to my son. I've been to the hostel since and they were shocked he was sent back to prison as in their words' he hadn't done anything wrong' I can't believe they can get away with acting like they do, I'm surprised they can even sit down as their heads are so far up their own backside.

He is now due for release in june this year 2016 and his PO who has never contacted him since he was recalled now wants to see him (not the same PO I might add) 5 weeks before his release.He would have served his full sentence.He is really stressing as to why she suddenly wants to see him. Surely he doesn't need a PO as he wont be released on licence. He's worried he wont be able to go home to his flat which I have paid for the last 2 years to give him a good start.Your advice would be very helpful. Many thanks

  82. I have a question...Why do probation officers need the name, number and address of who your staying with when you travel? Are they legally allowed to call and tell these people about your case? I am asking for someone I know that is in a very unique situation. He was falsly accused of a crime and even though he was innocent his lawyer encouraged him to take a plea deal where he was sentenced to probation. He doesn't want the family members he is staying with to know about his charges because they will think less of him for something he didn't do.

  84. A quick question (from the UK)... Is it normal for a Probation Officer to contact an offenders ex-partners and the original investigating officers in an effort to weight the case against him? Surely their decisions should be based on court records and conduct in prison? Not any further muck that they can rake-up?
    It seems over-zealous and over stepping the role of probation if you ask me. What do you think?

  87. been on sis probation for 5 yrs it ends in June pay everything off and classes still attending haven't passed all subjects yet but still attend every week night classes. math main one not ready to pass worried what might happen when June comes. will i be in trouble or half to stay on probation longer. scared of what might happen I work during day attend class at night. took 3 yrs to pay off fines etc and then classes and 2 kids on top that in 5 yrs time. my nerves are rocked would love if any one would give advice or intell of what most likely would or will happen.

  89. My daughter is on probation. This woman has her getting up at 6am to see if she has Togo within 2 hours for a UA. She gets back home from across town. Then at 12 she calls and wants her to meet her all across town to sign a paper this has been done every day she gets a small break Fri and sat but could Stoll have to go for a UA. Then by 4pm after getting home again this probation officer decides that she needs to attend a group meeting. In between these salts she has her baby that she has had trouble being with because some of this I know is the judge and that's fine because she's now paying for all the things she's done in the past. For give years we've never been able to have Christmas together as a family because she was held by a human trafficker and last year and this since she's been getting her life in order this probation officer put her in an abuse woman's shelter. I have no record or traffic tickets and every time my daughter goes to probation this woman always has negative things to say about me. I'm fully disabled and live in housing because I need to be closer to my doctors. One morning after being in pain I turned my phone off so I could sleep she told my daughter she called us and why didn't I answer. Gee I was asleep at 9-11am. This woman told my daughter I wasn't competent because I didn't answer for her. Then the first time she came to do an inspection I was not told in advance. I have two Chihuahuas and they use puppy pads which I clean daily. Whe she came she told the judge I had shit on my floor. That Pissed me off as I clean them when I wake up.. I'm not the one on probation my daughter is and this woman. Didn't want her to come home for Christmas or thanksgiving. This woman has some type of animosity towards me and I'm getting really fed up with her snide farms and I'm thinking I may have to make an appointment with her boss who is the judge. This woman has no business saying anything about me because she met me very briefly and I was in my night gown which I wear when I'm at home and having to lay down due to spinal issues. This woman said to my daughter that she didn't care that I'm going in for surgery on my back because my daughter wants to be here to help after my surgery and she told my daughter no!

I have a situation where I have had two probation officers, the first was good and understanding but the second is making excuses for my accuser and almost trying to convince me not to appeal my conviction, she hasn't bothered to read my file and is just going on the certainty that I am guilty.
    The judge ordered 10 days face to face with the probation officer over the course of the year, this I have already completed but the officer wants more sessions saying that it is for the whole year and not just 10 days!!
    Am I being bullied for not admitting or showing remorse for something I did not do?
    I am appealing the conviction and am very confident of overturning the verdict against me but the probation is clearly having an issue of my not accepting or admitting my guilt.
    What if anything can I do?

  92. I've got a question. Who would I speak with about a very rude irrate dickhead with that badge complex! I recently took my fiance to report and they was switching her officer. Ok well she had a spinal injection appt and should've had plenty of time between.. But time started getting late. A guy come out and I was respecully trying to ask a question because she was scared to say anything about her Dr appt and piss someone off well it is something she needs. But he didn't answer anything told me to shut up if I wasn't on probation or get out of his building!!! Well this is as much mine and everyone else's building considering its county square and paid for by tax payers!!! And yes I feel like I do have a right to speak up since my girlfriend was afraid to step on someone's toes or piss someone off and again I wasn't trying to be disrespectful I was respectful as I could be to anyone anywhere anytime I just want to know I want to go over his head and have a sit down meeting with him and get an apology from him who would I go to to arrange that would I go to the head of the probation department the governor or what???   93. My parole officer is upeset with me for staying a couple of nights at my boyfriends house without his prior approval and said he can get me for residency. We talked about me I gave himnights here and there with my boyfriend and he look into his background and found nothing wrong with my boyfriend him his address and phone number he said it was ok for me to stay a night here or there but he did want me to let him know when I did spend the night. I have to go in and see him today to talk to him about this Iwant to ask him if I can change my homeplan to my boyfriends house can he tell me no? Also will he put me on house arrest for staying the two days at my boyfriends without getting permission first?

My ex girlfriend whilst I was with her, decided not to tell probation that she was seeing me, she also decided to look at my file and the quizzed me about it outside of work, a few weeks later we finished our relationship after she asked for money and I said no, she then had me arrested after I called her a bitch in a text, I was sentenced to 40hrs community service for misuse of a telephone and she was given a protection order because of it, I was called into probation and asked why I was texting one of their officers, I to
    D them and made an official complant. Three days later I recieved an email from my ex basically telling me to drop the complant or she was releasing a video of me she made, is this a criminal offence and can I have her arrested for it here in New Zealand?

  95. My question is rather quick. My wife is currently incarcerated. Does her PO have the right to refuse an audience with me? My wife's sentence has been suspended and her PO has yet to talk to her or provide any information an what needs to happen in order for her to be released.

  98. Decent entertaining reading, but only that. I have close knowledge of a friend put on pretrial home confinement for a one time, first time, non violent crime. The guy is a disabled vet, 15 years service, with PTSD and a brain injury from Iraq. The ONLY thing he is truly guilty of was a bout of mental breakdown after his father died and he quit his meds and treatment during a 1 year period after this, causing a relapse of hallucinations and controlling voices which convinced him he needed to commit a minor crime with no actual victim. His country responded with extreme house arrest pretrial. Since he was disabled and on VA pension, it was determined that he had no traditional job, this never needed to leave his house. Even after he showed he was a full time caretaker of an ailing 75 year old mother who lived with him and can't even walk. So her bags of urine soaked Depends father in his house until he's allowed to take them 100 feet outside to the trash for 15 minutes twice per week. This is also the only time he's allowed to check his mailbox or even go outside to a storage room to get food out of a freezer. After MUCH begging, he was finally allowed 2 hours once a week to go to a local store for groceries or mow his large yard. The PO, actually LOOKING at the large rural yard, still thought 2 hours was too long. He also lived in a small farm, always something needing some. But now fenced are growing up, tin being blown off barns, and the entire 40 acres pretty much looking value daily. He asked, very nicely, for 1 hour per weekday at a specific time to take care of chores. But since he "doesn't have a job", he doesn't need anymore than that 2.5 hours per week. He also has a medically documented Vitamin D deficiency and can't take supplements because of a certain condition. The PO response was, "I'm not going to let you just go outside to get sunlight". He was prevented from going 3 miles from his home for a yearly decoration of his father's grave and also prevented from visiting the grave on Fathers Day. He was also not allowed to attend a lifelong friends funeral, since he couldn't arrange the burial 14 days in advance.this is only a tiny list of the inhumanities done to him by not just 1, but THREE POs, since they kept switching him around. This barbarism has convinced me a PO is just someone who gets kicks from controlling people who aren't as perfect as they are. So I have absolutely no respect for their kind and have started an active program, on behalf of my friend, of carefully documenting every unnecessary and unjust treatment of him and presenting the evidence to state and national representatives and congressmen. As slow as govt work, it won't help him. But it may eventually rein in the uncontrolled powertrips these people do for fun. I hope other citizens follow my lead to reform our nation's barbaric, draconian pretrial imprisonment system.

  102. I have a question my husband is starting weekends stints for a DWI conviction and I need to know if he decides not to pay or show up can I get charged? We have two children under two under no circumstances will I be a fall guy and lose my kids BC he wants to ruin his life. Also BC I'm sure when he has to be there I will have to be at work and since I have to provide then he can't get a ride. I just need some reassurance that his possible stupidity won't make me lose my kids.

I was sentence 2 yrs of probation for possessing brass knuckles. a year and a half later I've decided to refuse the probation. my officer tryed everything she could to convince me not to refuse. In a week I'm going back in to go to jail. She's telling me I still have to go by their rules or I'll be sanctioned up to 67 days before I can even see a judge for sentencing. How is it they can still control me after I told them "I am done, lock me up" They have pushed me around to much I just want to get this over with and get back to my life.

  104. So I looked up my record and found that I'm apparently still on felony probation from 6 yrs ago that was only supposed to last a year and a half. It also says I have a felony even though I was told it would be expunged after my community service and probation were over. What's going on here?

    1. Ok if you were told by someone like your po its wrong if you signed something from the DA then it shouldnt be their at all the only way to get it expunged is go through a process and go back to court and they decide if you are a productive member.

  105. I'm on a narcotic prescription and brought her all my paperwork from pharmacy. She wants me to sign release to talk to my doctor to take me off my meds. I refused to sign release and now I'm going back to court for violation because I wouldn't sign it?

  109. I was found guilty on a no show charge, but the thing is I was never told about a probation officer or anything plus the DA said that there was a misfile on my name so they never got anything on me, how am I still found guilty

    1. They dont care you have to understand that they see it as you should be able to find this classified stuff in their computer system out and show up and you cant and it wasnt a misfile they just didnt care i would have appealed it.

Why is it when your parole is almost up in a couple of weeks and you call your parole officer for two weeks straight to get the final appointment date they dont ever call you back and they secritary says hes in the office.i know if i didnt do my job at work ill be fired i guess its different for other people thats all

  111. I have a question. My husband was charged with a second domestic violence charge. He is in Crosswaeh Community Based Correctional Facility for 6 months. I had the no contact order lifted by the judge and the CPO modified for telephone calls. His probation officer added on his terms and conditions that he has no contact with me. Can the probation officer add this to his terms and conditions and how do I have it removed. Also we live in Ohio thank you so much!!

  114. OK so I'm on probation for an ovi. Just drinking nothing else. I reported by phone each month as I was supposed to. After 3 months I received a letter in the mail. The letter said that I NO LONGER have to call and report any longer. OK so I stop calling. Three months later officers show up at my house and arrest me for a probation violation. Well the violation was not calling my PO. Ummm I had a letter saying I didn't have to. I was taking to jail and did almost 4 days when my mother got ahold of my PO and read her the letter. The probation officer apologized many times. The PO called the judge and had me released that night. My question is what can I do here. They unlawfully came into my house on a warrant that should of never been written. I did jail time that I shouldn't have. Also my probation officer is trying to add things and make me do thinks that aren't on my papers. I'm in desperate need of info here guys can anyone help?

Let me add that I'm currently going to a out patient soboxone clinic-I've spent over 1000$ on securing my place there, I'm wanting to attend a rehab that will let me continue my treatment. Any place she chooses will not allow me to be on my program. Please if anyone knows anything let me know I'm in Texas. And I'm already wasting tax dollars by her requiring me to attend this place.

  121. Probation officers are like day and night there are so many gray areas and different ideologies. Its a total mess of an occupation. bottom line, some are tyrants and some are helpful its a craps shoot roulette table . that has very little structure.I fell sorry for the system and its clients.

  122. I just fired a probation officer. After six months on remand I was feeling suicidal when answering bail. I was remanded to prison for my own safety, where I received several credible death threats from my detoxing armed robber cellmate. I was also found, curled up in the cell shower screaming after a probation officer provoked a previously undisclosed childhood abuse memory. Despite requests to discuss this, I was left to fester in my nightmares and sleepless nights whilst I tried to come to terms with the memory. Once given a suspended sentence my probation officer's reaction to my feeling low during an interview was to call the police as soon as I had left the building. The very people who"helped" me by putting me in the path of threats and post traumatic stress, turn up on my doorstep asking me how feel.

    Trust, as you say, is earned. I've admitted my offence. I even paid for and attended a course which addressed my offending, while I was waiting to be charged.

    How can you justify doing more harm than good by your ineptitude, and expecting us to trust you?

    I have a knot in my stomach waiting to meet the new PO. I have decided to breach myself back into jail. At least I would feel safer there, than It would on probation.

  124. Brothers probation officer (3rd one) super nice guy right? Wrong. My brother did everything right paid ahead of time to the court paid on time to probation officer, did all the required classes, PO tells him your doing great and your last day of probation is April 17, 2017, you'll get a letter shortly. Oh yes he did. The letter was a VOP, the accusations were he did not pay court costs for Feb and March, yes he did it was all on the Clerk of the Courts Website, he did not pay 20.00 owed on his probation yes he did, he had the money order showing the 20.00, he did not take a required class by Feb 2017, it was not a required class but he took it anyway and received the certificate 3/1/2017. He did not impound his vehicle for 90 days, he does not own a vehicle. The PO's all knew this and never told him to provide the DMV report and they would waive the requirement. PO submitted a sworn affidavit to a Judge sent a text message to my brother how he hoped all would go well for him at the hearing and sorry if he caused him any negative issues. Really. Well he swore on an affidavit and lied to the Judge so lets see him got to jail. If I did that I'd be put away. To me a crime is a crime unless there is an unwritten rule that there are "special" people who are allowed to commit crimes and get away with it. I'd like someone to show me where anyone is allowed to lie to a Judge even a Probation Officer.

  126. My PA parole/probation officer is great, she is very personable and is straight up. I never had lied to her about anything. Why? I don't think you have to, unless you're doing something not right. She does her job well and thorough. Meeting tomorrow. Just have a problem with the peeing while being watched. First time couldn't do it, so came in the following day. Had to go do bad, I was dancing around the waiting room. But she is good and thorough. Like her a lot. Just saying.

  131. If I make a serious complaint about a probation officer and the investigation has been escalated...Is it right that the probation officer can still request to see me?
    I rang the office right away about not being able to attend with the particular officer as there is an investigation ongoing. I heard nothing more then received a warning letter about missing the appointment.
    I would have thought it common practice that if there was an investigation on going the officer should remove themselves from the situation at least until the investigation was completed.
    Can someone please advise?

Hey I've been on tag since 2015 and I was sentenced nearly 6 months ago I remain on tag nearly 3 years later and I'm on probation for next 2 years what a lovely sentance I would of rather done the bird but can probation help me with gym membership and course for me I come of tag soon I'm really nervous I suffer from multiple personality disorder generalise anxiety and ocd I've done 5 jail sentences I just need help to keep busy this is the first time in 3 years I've not had my bail revoked and no offended too I just can't be arsed to get bored and go back to doing crime any advice wanted tomb00077@gmail any answeres or advice welcome

  135. Can a probation officer stop you from going to a methadone clinic. I just got out of jail and I still feel like using I have insurance and they will pay for the clinic can he tell me I'm not allowed to go because I will fail my drug screens.
